You have to have your legal status in the country from where you would apply for immigration.

As far as I know, U should have entered in this country legally to apply Canadian PR. Your current status will not effect to apply if you entered legally. Before come up to any decision, please consult the lawyer. Email the lawyer asking only one question and they will answer one question without pay. In this way, you can make sure u r eligilble or not.
Of course www.cic.gc.ca is the best site to start up.
